§ 1 Scope, provider
These terms govern the provision and use of the "Dictum" software by Wizard Dynamics eGbR, Wieselweg 6, 85540 Haar (the "Provider"). A consumer is any natural person who enters into the transaction for purposes that are predominantly outside their trade, business or profession.
§ 2 Subject of the service
Dictum is dictation software for macOS that transcribes spoken language locally on the user's device and inserts it into other applications. Optionally, the transcribed text can be linguistically refined via an AI feature (see Privacy policy). The Provider grants the user a non-exclusive, non-transferable right of use for the contract term. There is no claim to specific features in unchanged form.
§ 3 Conclusion of contract
Downloading the app is free of charge. The paid contract is concluded when the user selects a subscription in the order process (Stripe checkout) and completes payment. Beforehand, the user creates an account via an emailed sign-in link.
§ 4 Free trial
The Provider grants a trial period of seven (7) days from first registration of the email address. If the subscription is not cancelled before expiry, it converts into a paid subscription. The trial is granted only once per user.
§ 5 Prices and payment
The subscription costs €14.99 per month or €149.90 per year. All prices include statutory VAT. Payment is made in advance via the payment provider Stripe. The subscription renews automatically for the chosen term until cancelled.
§ 6 Term and cancellation
The subscription may be cancelled at any time with effect from the end of the current billing period. Cancellation is possible via the payment provider's customer portal or by email to the Provider. Fees already paid for the current period are not refunded pro rata unless a right of withdrawal applies.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. Details are set out in the withdrawal policy. For digital content and digital services, the right of withdrawal expires early pursuant to § 356 (5) German Civil Code where the user has expressly consented to performance beginning before the end of the withdrawal period and has confirmed their knowledge of the resulting loss of the right of withdrawal.
§ 8 System requirements
Dictum requires macOS 12 or later on Apple Silicon hardware. The user is responsible for a compatible system environment.
§ 9 Availability and updates
The Provider supplies updates at its reasonable discretion but is obliged to do so only to the extent required by law. As the core function works locally, use is generally possible without a continuous server connection; account, payment and AI features require an internet connection.
§ 10 User obligations
The user is responsible for the content they dictate and process. If they enable the optional AI cleanup, they are themselves responsible — particularly for confidential content or content subject to professional secrecy — for verifying the admissibility of a transfer to third parties (see Privacy policy).
§ 11 Defects and warranty
The statutory provisions on the supply of digital products (§§ 327 et seq. German Civil Code) apply. Users are asked to report defects to the contact address above.
§ 12 Liability
The Provider is liable without limitation for intent and gross negligence and for injury to life, body or health. For slightly negligent breach of material contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical of the contract. Otherwise liability is excluded. Liability under the Product Liability Act remains unaffected.
§ 13 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the state in which the consumer has their habitual residence remain unaffected. Should individual provisions be invalid, the validity of the remainder is unaffected.
